TERMS OF SERVICE

These terms are the agreement between you and Clarke Entertainment Network covering your use of our websites, our audio streams and our other services. Please read them. By using any of our sites or streams, you accept these terms. If you do not accept them, please do not use the service.

1. WHO WE ARE

Clarke Entertainment Network ("we", "us", "our") operates Clarke Entertainment Radio Network, an internet radio network of nine online stations. Our contact address is contact@clarkeentertainmentnetwork.com. Our mailing address is 2120 E Fire Tower Rd, Ste 107 #2154, Greenville, NC 27858.

2. WHICH SITES AND STATIONS THESE TERMS COVER

These terms apply to our network hub and to the following stations:

Three of our stations were recently renamed and their new matching domains are not registered yet, so those stations are still served at their former addresses until each site moves. We will keep this list current as domains migrate and as stations are added or renamed.

3. ELIGIBILITY

You must be at least 13 years old to use the service. If you are under the age of majority where you live, you may use the service only with the involvement of a parent or guardian. If we learn that a user is under 13, we will close the account or stop providing the service to them.

4. WHAT THE SERVICE IS

The service is free, ad-supported and listener-supported online radio. It includes our audio streams, curated and on-demand programming, station pages and related content such as charts, show information and events. You do not acquire any ownership of, or any right to download or keep, anything you hear or see. The streams may be interrupted, a station may change its format or programming, and individual shows may be added or withdrawn. The service is provided "as available". We do not promise that any station or stream will always be available, uninterrupted or error-free.

5. ACCEPTABLE USE

You agree not to:

• record, rip, scrape, capture or download our streams, or attempt to do so;
• rebroadcast, retransmit, publicly perform, or otherwise redistribute our streams or programming;
• use our streams or content in any other app, service, broadcast or public venue without our written permission;
• circumvent, or attempt to circumvent, any technical, geographic, age or access restriction;
• use bots, scripts or automated tools to inflate listening figures, ad impressions or other metrics;
• interfere with the operation or security of the service, or attempt to gain unauthorised access to it;
• use the service for anything unlawful, abusive, harassing, hateful, defamatory or infringing; or
• use our names, logos or branding in a way that suggests you are affiliated with us when you are not.

We may suspend or end your access to the service, and remove any content you have submitted, if you break these rules.

6. INTELLECTUAL PROPERTY

Our names, logos, station identities and branding, including Clarke Entertainment Radio Network, LatinoRadio.org, Cottonwood Radio, WE'RE 80s, DiscoCast, Cajun Hits, Tejano Hitz, Vessels of Praises, Reveille Radio and Signal Unknown, belong to us or are used by us. You may not use them without our written permission, except to refer to us truthfully. The music, sound recordings, shows, artwork and other programming you hear or see belong to their respective rights holders, such as artists, labels, producers and publishers. They are made available to you for listening only, over our streams, for as long as we are licensed to make them available. Nothing in these terms gives you any right to copy, record, download, distribute, remix or reuse them. Music licensing notice. We hold the licences required to stream the music we play, and we pay the applicable royalties. If you are a rights holder or an authorised representative and believe your work is being used improperly, email contact@clarkeentertainmentnetwork.com with the details: what the work is, where it appears on our service, why you believe the use is unauthorised, and how we can contact you. We will look into it and remove material where that is appropriate.

7. THIRD-PARTY LINKS AND PARTNERS

Our sites contain links to third-party sites and services, including ticketing, travel, hotel booking, music download and streaming services, and sites belonging to our advertisers, sponsors and programming partners. We do not control those sites, we are not responsible for their content, products, services or terms, and their own terms and privacy policies apply once you leave our site. Some of those links are affiliate links and we may earn a commission if you buy through them. That does not change the price you pay.

8. ADVERTISING AND SPONSORSHIP

Advertising, sponsorship and promotional placements on our stations are governed by a separate insertion order or agreement between us and the advertiser or sponsor, plus these terms as they apply. Advertisers and sponsors agree that they are responsible for the content they supply, that they hold all rights needed to use it, and that it will not be unlawful, misleading, deceptive or infringing. Advertisers and sponsors also agree not to imply that we endorse their product or service beyond the placement itself. Important: the right to advertise or sponsor on a station is separate from, and is not covered by, our music licensing. A licence to stream music does not automatically permit advertising or sponsorship around that music. We confirm this before selling any placement.

9. LISTENER SUPPORT AND DONATIONS

Listener support is voluntary. Contributions are not a purchase of any goods or service, and they do not entitle you to any ownership interest, voting right, equity or guaranteed programming. Payments are handled by PayPal, whose terms also apply to your payment. Except where required by law, contributions are non-refundable. If you think you were charged in error, contact contact@clarkeentertainmentnetwork.com and we will look at it. Unless we tell you in writing that a recipient is a registered charitable organisation qualified to receive deductible contributions, contributions are not tax-deductible.

10. CONTESTS, GIVEAWAYS AND PROMOTIONS

Contests, giveaways and other promotions are governed by separate official rules. Where those rules conflict with these terms, the official rules control for that promotion. Eligibility restrictions, deadlines, prize details and how winners are chosen are stated in the official rules for each promotion. Some promotions are open only to residents of particular places.

11. CONTENT YOU SEND US

If you send us comments, song requests, shout-outs, contest entries, messages, photos or other material, you confirm that you have the right to send it, and you give us a non-exclusive, royalty-free, worldwide permission to use, reproduce, edit and publish it in connection with the service. We may identify you by the name or handle you provide, unless you ask us not to. How we handle the personal information connected with those submissions is described in our Privacy Policy.

12. COPYRIGHT COMPLAINTS

If you believe something on our service infringes your copyright, email contact@clarkeentertainmentnetwork.com with enough detail for us to identify the material, identify our site or stream, explain your rights in the work, and tell us how to reach you. We may remove material and end the access of repeat infringers.

13. DISCLAIMERS

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any station, stream, show or piece of programming will be available.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or relating to your use of the service. Our total liability for any claim relating to the service is limited to the greater of the total amount you paid us under these terms in the twelve (12) months before the claim arose, or, if you paid us nothing, One Hundred Dollars (US $100.00). Nothing in these terms limits liability that cannot be limited by law.

15. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and reasonable costs arising out of your use of the service, your content submissions, or your breach of these terms.

16. GOVERNING LAW AND VENUE

These terms are governed by the laws of the State of North Carolina, without regard to conflict of law rules. The courts located in Pitt County, North Carolina, have exclusive jurisdiction over disputes arising out of these terms, unless the law gives you the right to bring a claim elsewhere.

17. CHANGES TO THESE TERMS

We may update these terms. If we make a material change, we will post the new version with a new effective date and, where appropriate, tell you by email or on the sites. Continuing to use the service after the change means you accept the updated terms.

18. STATION-SPECIFIC ANNEX

The terms above are identical on every station in the network. Anything that differs by station belongs here. Each station's page should carry the entries for that station only.

Why this annex exists: two items in these terms carry real legal weight and must be true on each station's own page, not only on the hub. They are (1) the listener support and donation wording, including the non-refundable language, and (2) the advertising and affiliate disclosures. Keeping those in this annex is what allows one set of terms for the whole network instead of nine separate versions.
